ADM Photo & Video — Terms of Service
Effective
These Terms apply to services provided by Alchemy Digital Media Real Estate Photography & Videography, LLC, doing business as ADM Photo & Video (“ADM”). By booking a service with ADM, you agree to these Terms.
Booking & Payment
Prices shown when you place your order are the prices that apply to that booking, unless the information provided when booking is materially incorrect, such as property size or the services required.
Payment may be collected when booking or invoiced separately, depending on the service and client arrangement.
Where an order is processed and invoiced through Stripe, ADM will not also create a duplicate invoice for that order in FreshBooks.
Custom work or services outside our standard offerings may be quoted and invoiced separately.
Cancellation & Rescheduling
We understand that real estate schedules change.
24 hours or more before the appointment: You may cancel for a full refund or reschedule to another available appointment.
6–24 hours before the appointment: You may reschedule or cancel for an ADM account credit. Cash refunds are not provided during this period.
Less than 6 hours before the appointment: Please contact us. Cancellation, credit or rescheduling will be at ADM's discretion.
When account credit is issued, it will automatically be applied toward your next booking. If the credit exceeds the value of the new booking, the remaining balance stays on your account for future use.
If ADM must cancel or reschedule because of weather, safety, illness, equipment problems or another issue on our side, we will work with you to arrange another appointment.
Property Access & Preparation
Please make sure the property is accessible and photo-ready when our photographer arrives.
If we can access the property but it has not been prepared, we will normally photograph it as presented. An unprepared property does not automatically qualify for a refund, free return visit or extensive complimentary digital cleanup.
Our photographers may make small adjustments where practical, but they are not expected to move heavy furniture, boxes, appliances, valuables, fragile items or anything that could reasonably cause injury or damage.
If we arrive for a confirmed appointment but cannot gain access because working access instructions, keys, gate codes or similar arrangements were not provided, a $99 return-visit fee may apply.
We will not automatically charge that fee where access fails because of a genuine Supra/electronic lockbox malfunction or another issue outside the client's reasonable control.
Photography, Video & On-Site Services
ADM will use professional judgment when determining composition, lighting, camera position, shot selection and editing.
Drone services are subject to weather, airspace restrictions, FAA requirements and pilot safety decisions.
Authentic Twilight Photography and Authentic Twilight Videography depend on actual weather and atmospheric conditions. We cannot guarantee a particular sunset, sky color or cloud formation.
Appointment and delivery times are provided in good faith but may occasionally be affected by travel, weather, property conditions, production volume or circumstances outside our reasonable control.
Delivery & Payment
Photography is normally delivered according to the turnaround stated for the service. Video requires additional editing and may take up to 48 hours to complete.
We may deliver completed photography before video or other outstanding media is finished.
Where an order remains unpaid after the media is ready, the agent may be able to view low-resolution proofs with repeating watermarks, but clean High Resolution and Web Ready downloads remain locked until payment is received.
Attempts to remove watermarks or bypass payment restrictions are prohibited.
Once payment is confirmed, eligible completed media will normally unlock automatically.
If a full refund is issued automatically following an eligible cancellation, access to deliverables associated with that cancelled order may also be withdrawn.
For a refund issued manually by ADM, ADM will determine whether existing media access remains available based on the circumstances.
Photo Enhancements & Additional Editing
Some enhancements are selected after the photography has been completed, allowing you to choose the actual images you want adjusted.
Virtual Twilight: The first three Virtual Twilight images per property are complimentary. Additional Virtual Twilight images are $5 per image. Once the three complimentary selections have been used, choosing replacement images later does not restart the free allowance.
Virtual Staging: $20 per image.
Advanced Decluttering: $10 per image, unless an applicable brokerage agreement provides otherwise.
Virtual staging, virtual twilight and other digitally altered images are marketing representations. Agents are responsible for reviewing them and making any disclosures required by their MLS, brokerage or applicable rules.
Substantial object removal, wall-color changes, complex manipulation or other special requests may be treated as Custom Editing and quoted separately.
If ADM completes custom or additional editing before payment, we may provide a tiled-watermarked proof for approval. The clean adjusted image will be released after the applicable invoice is paid.
Payment for the original photograph does not include separately priced enhancements to that photograph.
Property Websites, 3D Tours & Floor Plans
Where included or purchased, ADM may provide branded and/or unbranded Property Websites.
For new orders that remain unpaid, the associated Property Website will not be made available to the agent or public until payment requirements are satisfied.
ADM may provide a Zillow 3D Home Tour and a Matterport 3D Tour using third-party platforms. Availability and hosting are therefore partly dependent on those providers.
If payment remains outstanding, ADM may withhold a 3D Tour link or keep the tour private where possible until payment is received.
Floor plans and measurements are provided as marketing aids and are approximate. They are not surveys, architectural drawings, appraisals or legal measurements.
Property information supplied by the client or obtained from other sources should be reviewed by the agent before publication. The agent remains responsible for the accuracy of listing information and compliance with MLS and brokerage requirements.
Copyright & Use of Media
Unless otherwise agreed in writing, ADM retains the copyright to the photographs, video and other copyrightable media we create.
Once the applicable order has been paid, the purchasing agent/client receives a non-exclusive license to use the delivered media for legitimate marketing of the property and, where appropriate, their real estate business.
This generally includes use on the MLS, Property Websites, real estate portals, brokerage websites, social media, digital advertising, email and print marketing.
Purchasing media does not transfer copyright ownership.
An unrelated third party—including another agent, brokerage, builder, designer, contractor or other business—does not automatically receive the right to use ADM media simply because they are connected with the property.
If a listing transfers to another agent or brokerage, the new agent should contact ADM regarding continued use of the media.
Unless otherwise agreed, ADM may use work we create in our portfolio, website, social media, advertising and other reasonable promotion of our services.
RAW photographs, unedited footage and production/project files are not included unless expressly agreed.
Digital & AI-Assisted Editing
ADM may use professional software, automated processing and AI-assisted tools as part of our photography, video and editing workflow.
Virtual staging, virtual twilight, object removal and similar services may digitally alter an image.
We will not intentionally use digital editing to deceptively represent a material permanent feature as existing when it does not.
The client is responsible for reviewing final media before publication and for making disclosures required by their MLS, brokerage or applicable law.
Corrections & Additional Requests
If you believe we have made a genuine processing or editing error, please let us know promptly and identify the affected media. We will determine the appropriate way to correct it.
A request for a different creative treatment, additional manipulation, extensive decluttering, replacement enhancement or other work outside the original service may be chargeable.
Our goal is always to resolve genuine production problems reasonably, while distinguishing corrections from new or additional work.
Media Storage
Please download and retain the media you need.
ADM's delivery system and Property Websites are not intended to serve as permanent archival storage. Media and websites may eventually be archived or removed after the applicable service/listing period.
Where extended hosting or restoration is available, additional charges may apply.
Email, SMS & Account Communications
By booking with ADM and providing contact information, you agree that we may send communications necessary to provide your services, including:
booking confirmations, appointment reminders, scheduling changes, payment notices, media-delivery notifications and account/security messages.
Where SMS notifications are enabled, standard carrier message/data rates may apply.
Providing a phone number does not automatically constitute consent to unrelated marketing SMS.
Marketing emails are separate from essential service communications. Unsubscribing from marketing does not prevent ADM from sending messages necessary to manage an active booking, payment, media delivery or account.
Third-Party Services
ADM uses third-party providers where appropriate for services such as payment processing, cloud storage, media processing, communications, 3D tours and website infrastructure.
We cannot guarantee uninterrupted operation of systems outside our control. If a third-party service experiences an outage, policy change or other failure, we will make reasonable efforts to resolve issues affecting your ADM service.
Liability
ADM will make reasonable efforts to provide the services ordered professionally and accurately.
However, we cannot guarantee a particular marketing result, number of showings, sale price, sale timeframe, online performance or other outcome from the use of our media.
To the extent permitted by law, ADM's liability arising from a particular order will not exceed the amount paid to ADM for the service giving rise to the claim. ADM will not be responsible for indirect or consequential losses, including lost commissions or lost business opportunities, where such limitations are permitted by law.
Nothing in these Terms limits rights or remedies that cannot legally be excluded.
General Terms
These Terms, together with the applicable booking, invoice or written custom quote, form the agreement between the client and ADM for the services ordered.
If a provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
These Terms are governed by the laws of the State of Florida.
ADM may update these Terms from time to time. The version accepted when an order is placed will be recorded with that order and will govern that booking unless both parties agree otherwise.
