Terms of Service

Effective Date: July, 17th, 2023

Welcome to Alchemy Digital Media Real Estate Photography & Videography, LLC (“ADM Photo & Video”). By using our services, you agree to be bound by these Terms of Service. Please read them carefully.

1. Services Provided

Alchemy Digital Media Real Estate Photography & Videography, LLC (“we,” “us,” or “our”) provides real estate media services, including but not limited to real estate photography, videography, and virtual tours, to real estate agents, brokers, rental companies, and builders (“clients”).

2. Copyright and Licensing

2.1 Copyright Ownership

All photographs, videos, and virtual tours created by ADM Photo & Video remain our exclusive property. We retain full copyright over all media content we produce.

2.2 Limited License for Use

Upon full payment, we grant the client a limited, non-exclusive, non-transferable license to use the media content solely for the marketing of the property for sale or rent.

  • Once the property has been sold or rented, this license automatically terminates.
  • The client may not use the media content for any future marketing or resale of the property without obtaining prior written consent from ADM Photo & Video.
  • The license does not permit the client to assign usage rights to any third party (except the local MLS board) without explicit written permission from ADM Photo & Video.

2.3 Prohibited Uses

  • Clients may not claim ownership of the images, videos, or virtual tours.
  • Clients may not alter, edit, or modify the media content without prior approval.
  • Clients may not sell, transfer, or distribute the content to any third party (including staging companies, architects, contractors, designers, or other real estate professionals) without written permission from ADM Photo & Video.
  • Unauthorized use or distribution of the media content will be subject to legal action.

3. Purchase of Copyright

If a client wishes to purchase full copyright ownership of any media content, they must submit a written request.

  • ADM Photo & Video reserves the right to approve or deny any copyright transfer request at our sole discretion.
  • If we agree to sell the copyright, an additional fee of up to ten (10) times the original service fee will be charged.
  • Full payment must be received before copyright ownership is transferred.

4. Payment Terms

  • Payment is due in full upon delivery of the final media content.
  • Late payments may be subject to additional fees and service delays.

5. Legal Action for Violations

We reserve the right to pursue legal action against any individual or entity that violates these terms, including unauthorized use, reproduction, or distribution of our copyrighted media content.

6. Changes to Terms

ADM Photo & Video reserves the right to update these Terms of Service at any time without prior notice. Clients are encouraged to review our Terms of Service periodically.
